Pursuant to adjournment the Platte County Board of Equalization met in session beginning at nine o’clock in the morning.

Honorable Arnold Stuthman, Chairman, Diane C. Pinger, County Clerk. Roll call and the following members present:  Supervisors Pfeifer, Friedrichsen, Lloyd, Woerth, Franzen, Tooley and Chairman Stuthman. The Affidavits of Publication from the Columbus Telegram and Humphrey Democrat for notice of public meeting were presented. Motion, Supervisor Franzen, seconded Supervisor Woerth, to approve the motor vehicle exemptions as recommended by the County Treasurer, motion carried. Motion, Supervisor Friedrichsen, seconded Supervisor Lloyd, to approve the tax corrections #13121 thru #13126 for real estate and personal property as recommended by the County Assessor, motion carried. Motion, Supervisor Franzen, seconded Supervisor Lloyd, the property of Bruce D. Foreman and Mary J. Foreman described as follows be removed from the County Industrial Tract:  A tract of land in the SE ¼ of Sec. 14, T17N, R1W of the 6th P.M., Platte County, Nebraska described as follows: Commencing at a point on the South right-of-way line of the UPRR at a point 450’ NW’ly from the intersection of the ROW with the East line of the NW 1/4 SE1/4 SE 1/4 of Sec 14; proceed NW’ly along the ROW a distance of 400’ to a point; thence SW’ly along a line making a right angle with the ROW a distance off 200’ to a point; thence SE’ly along a line parallel with the ROW a distance of 400’ to a point; thence NW’ly on a line making a right angle with said ROW a distance of 200’ to the place of beginning, said tract containing 1.83 acres more or less, motion carried. Motion, Supervisor Tooley, seconded Supervisor Friedrichsen, the property of Platte Tractor Company owned by Michael Jeffrey located at 5115 Howard Blvd, Columbus, Nebraska,  be removed from the County Industrial Tract, motion failed. The Chairman recessed the Board of Equalization until 1:00 p.m.

Motion, Supervisor Woerth, seconded Supervisor Tooley, to file the Veterans Service Officer quarterly report ending 

June 30, 2002, motion carried. Richard Snyder, Snyder Engineering Co., presented an update on the environmental cleanup of the Courthouse to the County Board.  Also present were Pat O’Neil from Environmental Direct and John Kreikemeier from R.L. Fauss. Motion, Supervisor Franzen, seconded Supervisor Lloyd, authorize the Building and Grounds Committee to reach a conclusion on the two rooms in the Highway Department regarding the ceiling and floor tile, motion carried.  Motion, Supervisor Pfeifer, seconded Supervisor Franzen, to file the State of Nebraska Department of Environmental Quality Application for Permit to Construct and Operate a Livestock Waste Control Facility for the following: Foltz Farms Livestock Operation, motion carried. Platte County Weed Superintendent requests the County Boards permission to cancel the account of Karen Nice in the amount of $45.00. Motion, Supervisor Woerth, seconded Supervisor Franzen, to approve the request from the Weed Superintendent to cancel the account of Karen Nice in the amount of $45.00 motion carried. Motion, Supervisor Friedrichsen, seconded Supervisor Woerth, to adopt Resolution No. 02-27 Approving Substitution of Securities for Pinnacle Bank, motion carried.

Motion, Supervisor Woerth, seconded Supervisor Friedrichsen, to file the PrairieLand RC&D meeting minutes of June 19, 2002, motion carried.

RESOLUTION NO. 02-28

               

                A RESOLUTION APPROVING THE EXECUTION AND PERFORMANCE OF A LEASE-PURCHASE         

                AGREEMENT WITH NACO LEASING CORPORATION FOR A ACQUISITION OF PROPERTY.

 

BE IT RESOLVED by the Board of Supervisors of the County of Platte, in the State of Nebraska, that this Board hereby approves and authorizes the acquisition of One (1) New 2002 Dodge Durango, Serial No. 1B4HS48N12F219213, by the County of Platte through a Lease-Purchase Agreement with NACO Leasing Corporation.  The Lease-Purchase Agreement shall include the following terms, with such changes as are deemed reasonable or necessary by the Chairman of the Board of Supervisors.

 

1.                    Principal Amount:  $26,938.00

2.                    Interest Rate:  2.950%

3.                    Payment Amount:  $9,478.65

4.                    Term:  July 18, 2002, through June 1, 2005

5.                    Payment Frequency:  Annually

 

Settlement and closing of the Lease-Purchase Agreement shall be on or about July 18, 2002.  NACO Leasing Corporation shall send payment to the equipment vendor or owner for acquisition of the property on the date on which NACO Leasing Corporation receives the signed Lease-Purchase Agreement and accompanying documents from the County.

 

BE IT FURTHER RESOLVED, that the Chairman or Vice Chairman of the Board of Supervisors and the County Clerk are hereby authorized and directed to sign the Lease-Purchase Agreement and related certificates and documents.

 

                                                This Resolution shall be in full force and effect from and after its passage.

WHEREAS, the report and study by the Platte County Highway Superintendent has been filed in favor of the vacation of a portion of SE 9th Street located in Section 35, Township 17 North, Range 1 East of the 6th P.M., Platte County, Nebraska; and

 

                WHEREAS, an offer of relinquishment has been med to the Township of Columbus, Nebraska; and

 

                WHEREAS, all provisions as set forth by Neb. Rev. Stat., Sec. 39-1722 have been satisfied.

 

NOW THEREFORE, BE IT RESOLVED THAT A PUBLIC HEARING BE HELD IN THE SUPERVISORS ROOM IN THE PLATTE COUNTY COURTHOUSE, COLUMBUS, NEBRASKA ON AUGUST 20, 2002, AT 9:30 A.M.  THE PURPOSE OF THE HEARING IS FOR TESTIMONY IN FAVOR OF AND OPPOSITION TO AND TO ANSWER QUESTIONS IN RELATION THERETO THE ABANDONMENT OR VACATION OF PART OF SE 9TH STREET MORE ACCURATELY DESCRIBED AS FOLLOWS:

The Chairman reconvened the Board of Equalization at 1:00 p.m. for the Property Valuation Protest Hearings to hear protest Nos 1 to 57.  At 5:30 p.m. the Chairman declared a recess of the Board of Equalization until July 17, 2002 at 9:00 a.m.  The Chairman reconvened the Board of Equalization on July 17, 2002 at 9:00 a.m. with the following members present: Supervisors Pfeifer, Friedrichsen, Lloyd, Woerth, Franzen, Tooley and Chairman Stuthman.  The Board  of Equalization heard Protest Nos. 58 to 94, 98 to 155 and 158.  At 5:00 p.m. the Chairman declared a recess of the Board of Equalization until July 18, 2002 at 9:00 a.m. The Chairman reconvened the Board of Equalization on July 18, 2002 at 9:00 a.m. with the following members present: Supervisors Pfeifer, Lloyd, Woerth, Franzen, Tooley and Chairman Stuthman. Absent:  Supervisor Friedrichsen The Board of Equalization heard Protest Nos 156 to 157, 159 to 198 and 95 to 97. Motion, Supervisor Woerth, seconded Supervisor Lloyd to approve the personal and real estate tax value technical changes as recommended by the County Assessor, motion carried. Motion, Supervisor Franzen, seconded Supervisor Woerth, to approve the recommended changes of the Board of Equalization on the following protests: Nos 1, 10, 18, 19, 20, 21, 22, 28, 29, 36, 39, 44, 47, 48, 49, 50, 52, 54, 59, 60, 90, 97, 99, 100, 108, 133, 158, 163, 181, 187 and 188, motion carried. Motion, Supervisor Pfeifer, seconded Supervisor Lloyd, to accept the County Assessor’s recommendations on protests Nos 2 to 198 except those listed in the previous motio, motion carried. Motion, Supervisor Woerth, seconded Supervisor Tooley, to approve the homestead exemption for Loretta Voichoskie motion carried.

Pursuant to adjournment the Platte County Board of Supervisors met for an Emergency Meeting beginning at four thirty in the afternoon. Honorable Arnold Stuthman, Chairman, Diane C. Pinger, County Clerk. Roll call and the following members present:  Supervisors Pfeifer, Friedrichsen, Lloyd, Woerth, Franzen, Tooley and Chairman Stuthman. Richard Snyder, Snyder Engineering Company presented results  of the lead paint tests for first, second and third floors.  He also stated per Steve Schlife, Health & Human Services, the Courthouse is good shape except for fourth floor.  Also present were Pat O’Neill from Third Party Environmental Inc and Mike O’Neil from Environmental Direct who answered any questions the County Board had. Motion, Supervisor Woerth, seconded Supervisor Friedrichsen, to approve claim number 02070412 in the amount of $12,000.00 for Third Party Environmental, Inc., motion carried.
