Pursuant to adjournment the Platte County Board of Equalization met in  session beginning at nine o’clock in the morning.

Honorable Arnold Stuthman, Chairman, Diane C. Pinger, County Clerk. Roll call and the following members present: Supervisors Pfeifer, Friedrichsen, Lloyd, Woerth, Franzen and Chairman Stuthman.  Absent:  Supervisor Tooley Moved, Supervisor Friedrichsen, seconded Supervisor Woerth, to approve the motor vehicle exemptions as recommended by the County Treasurer, motion carried. Moved Supervisor Franzen, seconded Supervisor Lloyd, to approve tax corrections #13119 thru #13120 for real estate and personal property as recommended by the County Assessor, motion carried.

Roll call and the following members present:  Supervisors Pfeifer, Friedrichsen, Lloyd, Woerth, Franzen and Chairman Stuthman. Absent:  Supervisor Tooley The Affidavits of Publication from the Columbus Telegram and the Humphrey Democrat for notice of public meeting were presented. The County Sheriff discussed the proposed change order for the new jail with the County Board. Motion, Supervisor Woerth, seconded Supervisor Franzen, to allow the change order at the detention facility to remove one wall in the amount of $1,610.00, motion carried. Motion, Supervisor Pfeifer, seconded Supervisor Lloyd, to approve the monthly fee reports motion carried. Motion, Supervisor Woerth, seconded Supervisor Friedrichsen, to file the Veteran’s Aid Expenditure report for May 2002, motion carried. Motion, Supervisor Lloyd, seconded Supervisor Pfeifer, to file the Northeast Nebraska Economic Development District meeting minutes of May 29, 2002, motion carried. Motion, Supervisor Pfeifer, seconded Supervisor Franzen, to file the Nebraska Accountability and Disclosure Commission Contractual Interest Statement for John Woerth, motion carried. Motion, Supervisor Woerth, seconded Supervisor Friedrichsen, file the County Treasurer Receipts representing credit to the respective funds:

Motion, Supervisor Lloyd, seconded Supervisor Woerth, that Platte County renew their membership dues to the Northeast Nebraska Economic Development District for 2002-2003, motion carried. Steve Otten, Minnesota Corn Processors is requesting the County Board to consider vacating a portion of a county road – Old Bruegger Road. Motion, Supervisor Franzen, seconded Supervisor Woerth, to authorize the Highway Superintendent to proceed with the abandonment on a portion of the Old Bruegger Road No. 391, motion carried. Motion, Supervisor Woerth, seconded Supervisor Friedrichsen, to authorize the Chairman to sign the new Cooperative Agreement between the Clerk of the District Court and Nebraska Health and Human Services/Child Support Enforcement  motion carried. Motion, Supervisor Woerth, seconded Supervisor Friedrichsen, to approve the minutes of June 4, 2002 and June 7, 2002, motion carried. Motion, Supervisor Pfeifer, seconded Supervisor Woerth, to remove from the table the matter of the revised application for M & H (Jamie Meyer Jr) Livestock Operation, motion carried. Motion, Supervisor Pfeifer, seconded Supervisor Lloyd, to file the revised application for permit to construct and operate a livestock waste control facility for M & H(Jamie Meyer Jr) Livestock Operation received from the State of Nebraska DEQ, motion carried. Richard Snyder, Snyder Engineering Co., Inc presented a building renovation update to the County Board.    Motion, Supervisor Pfeifer, seconded Supervisor Friedrichsen, to go into executive session at 10:33a.m., motion carried. Motion, Supervisor Woerth, seconded Supervisor Friedrichsen, to conclude the executive session at 10:57a.m., motion carried. Mike West, Carlson West Povondra Architects and R.L. Fauss discussed the new Supplemental Agreement with attachments with the County Board. Motion, Supervisor Woerth, seconded Supervisor Friedrichsen, to approve the change order in the dollar amount of $84,258.00 as per the agreement, with the terms and conditions to be finalized by legal counsel, motion carried. Motion, Supervisor Franzen, seconded Supervisor Pfeifer, to authorize the Chairman to sign the Agreement between Platte County and R.L. Fauss after  approval by the Judiciary Committee on June 21, 2002 by 4:00 p.m., motion carried. Motion, Supervisor Franzen, seconded Supervisor Friedrichsen, to file the PrairieLand RC&D meeting minutes of May 15, 2002, motion carried.

 

The County Website was discussed by the County Board.  After listening to presentations from Community Internet and Nebraska OnLine, the County Board decided to stay with Nebraska OnLine. Motion, Supervisor Franzen, seconded Supervisor Woerth, to authorize the Chairman to sign the utility application for Cornhusker Public Power District motion carried. Motion, Supervisor Pfeifer, seconded Supervisor Lloyd, to authorize the Chairman to sign the utility application for Louis Dubbs motion carried. Motion, Supervisor Lloyd, seconded Supervisor Pfeifer, to authorize the Chairman to sign the utility application for Frontier Communications, motion carried.

                The following resolution was presented:

RESOLUTION NO. 02-21

 

                WHEREAS, the Platte County Treasurer may by and with the consent of the Platte County Board of Supervisors invest            

                Surplus funds, and

 

                WHEREAS, it is in the best interest of the County of Platte that any surplus county funds be invested.

 

                NOW, THEREFORE, BE IT RESOLVED, that the County Board of Platte County, Nebraska, shall and does hereby give

                its consent to the Platte County Treasurer to invest in United States government bonds, bonds and debentures issued either

                singly or collectively by any of the twelve federal land banks, under the supervision of the Farm Credit Administration,

                United States Treasury Notes, from the date of purchase, or in certificates of deposit.  The interest received from        

                Investments shall be credited to the County General Fund of Platte County Fiscal Year 2002-2003.

Motion, Supervisor Franzen, seconded Supervisor Lloyd, to adopt Resolution No. 02-21 regarding the investment of surplus fund by the County Treasurer, motion carried.

                The following resolution was presented:

RESOLUTION NO. 02-22

 

                WHEREAS, the Platte County Treasurer has for a number of years co-mingled funds from various governmental bodies

                for the purpose of meeting the minimum investment requirements necessary to receive higher interest rates on the

                investment of such funds pursuant to law; and

 

                WHEREAS, the Platte County Treasurer has been distributing the interest received from such investments to such

                Various bodies proportionate to each body’s respective contribution to the principal amount of such investment; and

 

                WHEREAS, the Platte County Treasurer desires that this practice be ratified and approved by the County Board of

                Supervisors.

 

NOW, THEREFORE, BE IT RESOLVED, that to the full extent permission under law, the practice of the Platte County  Treasurer of co-mingling funds from various governmental bodies for the purposes of meeting the minimum investment

                requirements necessary to receive higher interest rates and the distribution of such funds in  proporation to the

                respective body’s share of the investment be ratified, approved and authorized.

                Whereupon the Chairman declared the motion carried.

                The following resolution was presented:

RESOLUTION NO. 02-23

 

                WHEREAS, there exists an emergency in the County certain departments operating within the County General fund

                Which has been created by necessary unanticipated expenses arising therein.

 

                WHEREAS, it appears that the departments immediately following will be overdrawn when the June 2002 claims are

                Allowed in the sum of $1,032,649.41.

 

                                                                General Miscellaneous                                           $  28,715.36

 

                and

 

                WHEREAS, such an additional appropriations needs to be made to meet such emergency expense.

 

                NOW, THEREFORE, BE IT RESOLVED, that in accordance with Section 23-918 Revised Statutes of Nebraska, that

                an additional $28,715.36 be appropriated out of the unexpended General Fund items of the 2001-2002 County Budget

                to meet such emergency for the several departments.

Motion, Supervisor Lloyd, seconded Supervisor Franzen, to adopt Resolution No. 02-23 concerning overextended budgets, motion carried.

Motion, Supervisor Woerth, seconded Supervisor Pfeifer, to file the Certificate of Liability Insurance for Egeland Water Systems, motion carried.   Motion, Supervisor Woerth, seconded Supervisor Lloyd, to adopt Resolution No. 02-24 Approving Withdrawal of Securities from Pinnacle Bank, motion carried. Veterans’ Service Officer requests the County Board to appoint one of the following to the Veterans’ Service Committee: Owen Lloyd who has accepted re-nomination, Raymond Wagner or Ron Hitch.               

Motion, Supervisor Friedrichsen, seconded Supervisor Pfeifer, to appoint Raymond Wagner to the Veterans’ Service Committee, motion carried.   Committee Reports: Supervisor Franzen attended the NIRMA meeting in setting costs for the new fiscal year.  Supervisor Woerth reported after the approval of the buzzers for the three offices, he approved one additional buzzer for $50.00.  Supervisor Stuthman attended the City Council meeting on the 3rd Avenue viaduct.  He stated the County’s feelings that a viaduct is not needed at this time.  If a viaduct is needed, 3rd Avenue is the logical place.  Bookmobile contract will remain the same except for the dates and figures and extended for two years.

Motion, Supervisor Friedrichsen, seconded Supervisor Pfeifer, that the following claims be approved as presented and that the County Clerk be ordered to issue warrants of the same on the General Fund, motion carried.
