The following resolution was presented: RESOLUTION NO. 03-15 BOARD OF COUNTY SUPERVISORS PLATTE COUNTY,NEBRASKA RESOLUTION MANDATING A HIPAA COMPLIANCE INITIATIVE AND APPOINTING HIPAA COMPLIANCE COORDINATORS AND PRIVACY OFFICERS WHEREAS, pursuant to Neb.Rev.Stat.§23-104(6) (Reissue 1997) Platte County has the power to do all acts in relation to the concerns of the County necessary to the exercise of its corporate powers; and, WHEREAS ,pursuant to Neb.Rev.Stat.§23-103 (Reissue 1997), the powers of a county as a body are exercised by the County Board; and, WHEREAS, Congress enacted the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), Governing the protection of and release of Protected Health Information (“PHI”),and, WHEREAS, entities such as Platte County are impacted by HIPAA because of the Health Plan and Health Care aspects of county government which contain PHI; and, WHEREAS, Platte County hereby states its intent to establish a HIPAA Compliance Initiative so that Platte County will meet the federal mandates imposed by HIPAA; and, WHEREAS, Platte County requires a HIPAA Coordinator, who will oversea and organize the HIPAA compliance efforts of Platte County; and, WHEREAS, Platte County requires a HIPAA Privacy Officer, who will oversea the privacy of records; and, WHEREAS, Platte County appoints and recognizes Platte County Clerk, Diane C Pinger and Janel Vrba as the HIPAA Coordinators and Privacy Officers for Platte County; NOW,THEREFORE,BE IT RESOLVED BY THE PLATTE COUNTY BOARD OF SUPERVISORS THAT Platte County hereby adopts and supports a HIPAA Compliance Initiative; AND,BE IT FURTHER RESOLVED THAT Diane C Pinger and Janel Vrba are hereby appointed and recognized as the HIPAA Coordinators and Privacy Officers for Platte County. BE IT RESOLVED BY THE PLATTE COUNTY BOARD OF SUPERVISORS THAT Platte County is hereby designated as a “hybrid covered entity”: for the purposes of HIPAA compliance; BE IT FURTHER RESOLVED, THAT the list of “health care components” contained within this Resolution is adopted as the operating model for purposes of HIPAA compliance; AND, BE IT FURTHER RESOLVED, THAT the HIPAA Coordinators are authorized to amend the above-mentioned  list of “health care components” as required over time to maintain ongoing HIPAA compliance. Moved and seconded Platte County participate in the matching funds to the extent of our county population compared to the total population in the district on a proactive basis. Motion carried. Allan Vyhnalek, Ext Educator discussed the 4-H Coordinator position with the Co Bd. Moved and seconded approve the summer employee for the extension office for the twelve weeks. Motion carried. Gary Parker discussed the formation of a Rural Road Improvement District with the Co Bd. Moved and seconded a hearing be set for April 15,2003 at 10:00a.m. on the formation of a Rural road Improvement Dist No. 2 from 63rd  Street to 61st Street from 49th Avenue to 48th Avenue, all referred to as Country Club Drive. Motion carried. The Co Assessor discussed the GIS System with the Co Bd. Marcus Tooze from GIS System gave a presentation and answered any questions the Co Bd had. Moved and seconded to refer the asphalt recycling bids to the Hwy Supt to review and report back with his findings.Motion carried.Moved and seconded to accept the asphalt recycling bid from Brown & Brown for Project No C-71(589) and C-71(590) in the amt of $245153.50.
