Special Meeting of Colfax, Platte and
Stanton Board(s) of Commissioners/Supervisors minutes. A special meeting of the
Bd of Commissioners/Supervisors of Colfax, Platte and Stanton
County, Nebr was held at the
multi-purpose activity building located on the Colfax County Fairgrounds in Leigh,
Nebraska on the 16th day of
June,2006 at 10:00a.m. Present were:
Tom Krivohlavek and Paul Pekarek, Colfax county Commissioners and Sharon K
Bohaboj, Colfax County Clerk; Absent:
Earl V Wendt, Colfax County Commissioner; John Woerth, Joe Tooley, Ronald
Pfeifer, Thomas Martens, Robert Lloyd, Bernie Friedrichsen and Myron Franzen,
Platte County Supervisors and Diane Pinger,Platte County Clerk; Dennis Kment,
Jerry Weatherholt and Joe Gillespie, Stanton County Commissioners and Martha
Detlefson, Deputy Stanton County Clerk. Notice of this meeting was given in
advance thereof by posting written notice and publication in each of the three
counties. Availability of the proposed agenda was communicated in advance notice
and in the notice to the board. All proceedings shown were taken while the
meeting was officially convened and open to the public. The Colfax County Clerk
recorded the minutes of the meeting. Colfax County Chairman, Tom Krivohlavek
presided over the hearing and began the meeting with the pledge of allegiance
and roll call. Motion Stanton County Commissioner Weatherholt; second Platte
County Supervisor Woerth to open a public hearing at 10:00a.m. for the purpose of hearing testimony of support,
opposition, criticism, suggestions or observations for the registered voter of
the Leigh Rural Fire District and the Village of Leigh for the proposed
inclusion of the location of the boundaries of the Leigh Rural Fire District
and merger thereof. Voting Yes: All. Voting No: None. Motion carried.The Colfax
County Clerk stated that proper notice of the meeting and hearing had been
published for two weeks with the last publication appearing not less than seven
days prior to the hearing in the county newspapers in each of the three
counties and copies of the notice were also provided to each of the counties
and the Village of Leigh for posting of this hearing. Notice published pursuant
to 35-533 of the Nebr Statutes. Colfax Chairman Krivohlavek then asked if a
representative from the Village of Leigh
would like to provide testimony to the proposed merger. Larry Fuhr represented
both the village and rural fire district stating that the merger will make
paying bills simpler as it tends to be somewhat confusing now with the village
paying a potion of the bills and the rural fire district paying a portion. He
also added that Howells Village
and Howells rural Fire went through the same process a few years ago and it
appears the merger is working well. He also stated that the area is already
being protected so there would be no change in the boundaries except for adding
the city limits of Leigh into the Leigh Rural Fire Protection District. Platte
County Supervisor Pfeifer asked how representation on the newly formed fire
protection district board of directors will be handled to ensure all counties
are represented equally. Larry Karel, Attorney for the Village
of Rural Fire, referred to the
statute for the election of directors. Platte County Supervisor Myron Franzen
asked if the levy authority for budget purposes will change since Colfax
County would more than likely have
the greater valuation with the inclusion of the valuation of Leigh after the
merger. The Colfax County Clerk responded that she did not have current
valuation figures, but more than likely have the greater valuation with the
inclusion of the valuation of Leigh after the merger. Mike Malena, secretary
for the Leigh Rural Fire District stated the merger is more of a convenience to
both political subdivisions and again stated bill paying would be simplified.
Larry Karel stated that votes by both the Village
of Leigh and Leigh Rural Fire
District were unanimous on passing resolutions to merge. Others in attendance
were Sandra Zoubek, Stanton County Treasurer. No one in opposition to the
merger was present at the hearing. After approximately 15 minutes of discussion
on electing the board of directors and levy authority, motion Colfax County
Commissioner Pekarek; second by Platte County Supervisor Pfeifer to close the public
hearing at 10:14a.m. Voting Yes:
All. Voting No: None. Motion carried. Larry Karel presented resolutions to each
county for review and approval. Motion Stanton County Commissioner Kment;
seconded Stanton County Commissioner Gillespie to approve the resolution
providing for the merger of the Village
of Leigh and Leigh Rural Fire
District. Voting Yes: Kment, Gillespie and Weatherholt. Voting No: None. Motion
carried. Platte County
reserved the right to have their county attorney review the resolution prior to
approval. Colfax County
reserved the right to approve the resolution until the next regular board
meeting when all members of the Clorox
County Board of commissioners are present. Larry Karel informed the boards that
while immediate action was not necessary, the statute requires board action
within 45 days from this hearing. The Colfax County Chairman adjourned the

vehicle exemptions as recommended by the Co Treasurer: Rainbow Center, Columbus
Rescue Mission, NorthStar Services, Col Comm Hospital and First United
Methodist Church.Motion carried.Moved and seconded that the property valuation
protest hearings be set for the afternoon on July 18, 2006, July 19, 2006 ant

the Platte Co Bd Supervisors be moved from July 4, 2006 to Wednesday
July 5, 2006. Motion carried. Jeff Peetz,Attorney discussed the
CASA Program with the Co Bd. Jack Abbott from Benefit Adm Systems is requesting
the Co Bd to consider the renew the county’s health insurance with their
company. A hearing was held at 10:00a.m.
to review the performance of the cable permit holder USA Companies, L.L.C. dba
Cable Nebr. Moved and seconded to conclude the hearing at 10:08a.m.Motion
carried.Mike Munson is requesting the approval of the final plat and Res No.
06-16 for the estates of Lake Oconee Fifth Subdivision. The following
resolution was presented: RESOLUTION NO. 06-16 RESOLVED, that the plat for the
Estates of Lake Oconee Fifth Subdivision, a subdivision of part of the NW 1/4
of 18-T17N-R1W, Platte County, Nebraska is hereby approved; and RESOLVED
further, that the 40’ road right-of-way with a 24’ roadway in lieu of a 60’
road right-of-way is hereby approved; and RESOLVED further, that the Chairman
of the Platte County Board of Supervisors is hereby authorized to sign said

RESOLUTION NO. 06-15 WHEREAS, the Platte County Board of Supervisors have
declared an emergency in the County within the County General Fund as stated in
State Statute
13-510; WHEREAS, the purpose is to account for all revenues
and expenditures not allocated to another fund, financing the principle
services of the county; WHEREAS, a need of an additional appropriation of one
hundred sixty thousand dollars ($160,000.00) in expenditures exists for the continued
operation of the County General Fund for the remainder of 2005-2006 fiscal
year. BE IT HEREBY RESOLVED BY THE BOARD OF SUPERVISORS of Platte
County,Nebraska on this 20th
day of June,2006, that said Board of Supervisors authorize the County
Clerk to increase the budget to
spend an additional one hundred sixty thousand dollars ($160,000.00) from the
County General Fund for the remainder of the fiscal year. Dated this 20th

06-11 WHEREAS, the Platte County Treasurer has for a number of years co-mingled
funds from various governmental bodies for the purpose of meeting the minimum
investment requirements necessary to receive higher interest rates on the
investment of such funds pursuant to law; and WHEREAS, the Platte County
Treasurer has been distributing the interest received from such investments to
such various bodies proportionate to each body’s respective contribution to the
principal amount of such investment; and WHEREAS, the Platte County Treasurer
desires that this practice be ratified and approved by the County Board of
Supervisors. NOW,THEREFORE, BE IT RESOLVED, that to the full extent permission
under law, the practice of the Platte County Treasurer of co-mingling funds
from various governmental bodies for the purposes of meeting the minimum
investment requirements necessary to receive higher interest rates and the
distribution of such funds in proporation to the respective body’s share3 of

The following resolution was presented: RESOLUTION NO. 06-12 WHEREAS, the
Platte County Treasurer may by and with the consent of the Platte County Board
of Supervisors invest surplus funds, and WHEREAS, it is in the best interest of
the County of Platte that any surplus county funds be invested. NOW, THEREFORE,
BE IT RESOLVED, that the County Board of Platte County, Nebraska, shall and
does hereby give its consent to the Platte County Treasurer to invest in United
States government bonds, bonds and debentures issued either singly or
collectively by any of the twelve federal land banks, under the supervision of
the Farm Credit Administration, United States Treasury Notes, from the date of
purchase, or in certificates of deposit. The interest received from investments
shall be credited to the County General Fund of Platte
County fiscal year

RESOLUTION NO 06-13 WHEREAS, there exists an emergency in the County certain
departments operating within the County General Fund which has been created by
necessary unanticipated expenses arising therein. WHEREAS, it appears that the
departments immediately following will be overdrawn when the June 2006 claims
are allowed in the sum of $282,519.84. Register of Deeds $530.20- Assessor
$658.56- Election Commissioner $2087.39- Clerk of the District Court
$14,958.51- County Court $46,051.07- Public Defender $2,504.12- Sheriff
$8,496.85- Attorney $29,468.28- Civil Defense $1,361.69- Miscellaneous
$96,137.97 and WHEREAS, such an additional appropriations needs to be made to
meet such emergency expense. NOW, THEREFORE, BE IT RESOLVED, that in accordance
with Section 23-918 Revised Statutes of Nebr, that an additional $202,255.64 be
appropriated out of the unexpended General Fund items of the 2005-2006 County
