Pursuant to adjournment the Platte Co Bd Equalization met in session beginning at 9:00 in the morning.Honorable Robert Lloyd,Chairman,Diane C Pinger,Co Clk.Roll call and the following members present: Supervisors Martens, Friedrichsen,Woerth,Pfeifer,Franzen,Tooley and Chairman Lloyd.The Chairman informed the public of the posting of the open meeting laws.The Aff Publ for the meeting were published in the Humph Demo on 7/10/08 and the Col Tele on 7/8/08.Moved and seconded to approve the agenda as presented.Motion carried.Moved and seconded to approve the minutes for 6-17-08.Motion carried.Moved and seconded to approve tax correction #13403 on real estate as recommended by the Co Assessor.Motion carried.Moved and seconded to approve the following motor vehicle exemptions as recommended by the Co Treas: St Isidore Church of Columbus, Rescue Mission, Columbus Comm Hospital, St Vincent De Paul/Simon House Inc, Rainbow Center Inc, and Youth for Christ Columbus Inc.Motion carried.The Chairman declared a recess until 1:00 p.m. for the Property Valuation Protest hearings. The Chairman reconvened the meeting at 1:00 p.m. The Chairman has decided instead of signing the protest, he will use his signature stamp as an approved substitute. The Property Valuation Protest hearing was held to hear protest nos 1-17 and 19-47. Moved and seconded to approve the Co Sher request for a new monitor at the jail in the amt of $629.00 to be paid from the capital acct.Motion carried. Discussion and vote on whether to accept option 3 or option 4 for renewal of the Platte Co Hlth Plan as presented by BAS. Moved and seconded to go with option 3 for the next year unless changed by the Personnel Comm to option 4 by the recommendation of Jack Abbott. Motion carried. Rich Chisholm, Chief Probation Officer discussed the budget with the Co Bd.Moved and seconded to appoint OCI Insurance& Financial Services of Omaha as the new broker with the their agent, Todd Drapal, to be agent of record for the Platte Co Hlth Plan effective renewal date of 8-1-08.Motion carried. Anthony& Mike Stec discussed the Loup River at the Gerhold Pit, property line taxes and 4 wheelers on the river with the Co Bd.Moved and seconded to remove from the table the approval of the final plat and Res No. 08-31 on Country Shadows Fourth Subdivision. Consideration of rescinding/revision of language in Resolution No. 08-06 (relating to Max and Wilma Jenny’s application for access road to isolated land and their obligations to provide for fencing) and entry of a new and final resolution relating to such application and issued of fencing obligations and setting damages in favor of all interested property owners. The following resolution was presented: RESOLUTION NO. 08-33 WHEREAS,the Platte County Board of Supervisors has previously been presented with an Application and Affidavit in support of the Board establishing a public access road to an isolated tract of land by Applicants, Max and Wilma Jenny, such Application and affidavit satisfying the requirements of Neb.Rev.Stat. Sections 39-1713 to 39-1719, and that notice and hearing as required has been duly provided and held and under the authority of the same, resulting in the Board approving such Application and passing and adopting Resolution Number 08-06 on the 18th day of March, 2008; and WHEREAS Platte County Board of Supervisors, after further review of Resolution Number 08-06 and consideration of additional facts and law, wishes to rescind particular language within Resolution Number 08-06 relating to Max and Wilma Jenny’s obligation to install or cause to be installed at their own expense a proper legal boundary fence, such language consisting of the following: “…the Applicants, Max Jenny and Wilma Jenny, shall install or cause to be installed at their own expense, a proper legal boundary fence, utilizing fencing materials now located on the access road above described, along with such additional fencing materials as may be required, with access gates to each of the adjoining properties to that the boundaries of such access road are properly fenced.” WHEREAS, the Platte County Board of Supervisors intends to pass and adopt this Resolution No. 08-06 to correctly supplement, portray and describe the wishes and desires of the Platte County board of Supervisors regarding the previous approval of the Application for such access road, as well as the damages relating thereto; and WHEREAS, John A. Wurdeman, a certified general real estate appraiser, has submitted his report entitled “Condemnation Appraisal” and subsequent letter of “adjustments to the cost to cure items” to the Board of Supervisors of Platte County, regarding his appraisal of the fair market value of the land covered by said access road so that damages may be assessed by the Board as provided by Neb.Rev.Stat. Sections 39-1716 to 39-1718; and WHEREAS, Thomas A Tremel, Platte County Surveyor, has undertaken a legal survey of such access road, the official plat and staking of a lathe line at approximately 200 ft intervals on both the east and west right-of-way lines, and submitted a bill of $950.26 for such services; and WHEREAS, The Platte County Board of Supervisors has given the owner or owners of the real estate over or through which the access road will be provided an opportunity to submit written agreements to the Board regarding the damages needing to be assessed by the Board, and that no such written agreements between the property owners and Max and Wilma Jenny have been submitted for the Board’s consideration. Motion failed.Moved and seconded to table this issue to 8-5-08.Motion carried.Committee Reports: Supervisor Woerth reported the sally port needs a new garage door opener and a new refrigerator for the community room, both items will be on the next agenda. He also stated there was an issue with the sidewalk on the east side of the courthouse, the ground is saturated and the soil needs to be replaced. Supervisor Friedrichsen will attend a meeting on Friday (18) in Madison at the Juvenile Detention Center. Supervisor Tooley will attend the Chamber meeting on Monday (21).Supervisor Pfeifer reported the Road-Bridge Comm met and discussed East 29th Avenue and the Hwy Dept secretary’s salary. He also reported the Judiciary Comm met and reviewed the applications for the position of County Attorney. Supervisor Franzen reported NIRMA is sponsoring a “Self Defense” Course for County Officials, an educational program on August 7-8,2008 in Kearney where all the materials are supplies by NIRMA. Supervisors Lloyd and Martens reported of drainage issues. Moved and seconded that the following claims be approved as presented and the County Clerk issue warrants of the same on the respective funds. Motion carried. Pursuant to adjournment the Platte Co Bd Supervisors met in session for a special meeting beginning at 2:00 p.m. in the afternoon.Honorable Robert J Lloyd,Chairman,Diane C Pinger,Co Clk.Roll call and the following members present: Supervisors Martens,Friedrichsen,Woerth,Pfeifer,Franzen,Tooley and Chairman Lloyd.The Chairman informed the public of  posting of the open meeting laws.The Aff Publ for the meeting were published in the Humph Demo on 7-17-08 and the Col Tele on 7-15-08.Moved and seconded to approve the agenda as presented.The Co Bd of Supervisors along with the assistance of Atty Mark Sipple interviewed four applicants for the position of Platte County Attorney. Moved and seconded to appoint Carl Hart Jr to the position of Platte Co Atty for the remainder of the term. Motion failed.Moved and seconded to appoint Sandra Allen to the position of Platte Co Atty for the remainder of the term. Motion carried.Moved and seconded the appointment of Sandra Allen as the Platte Co Atty will be effective
