Pursuant to adjournment the Platte Co Bd Equalization met in session beginning at 9:00 in the morning.Honorable Robert Lloyd,Chairman,Diane C Pinger,Co Clk.Roll call and the following members present: Supervisors Friedrichsen,Micek,Pfeifer,Franzen,Tooley and Chairman Lloyd. Supervisor Martens was excused for a medical emergency. The Chairman informed the public of the posting of the open meeting laws.The Aff Publ were presented with the meeting notice published in the Col Tele on 1-13-2009 and the Humphrey Demo on 1-14-2009.Moved and seconded to approve the agenda as presented.Motion carried.Moved and seconded to approve the minutes of

Pursuant to adjournment the Platte Co Bd Supervisors met in session beginning at 9:10a.m.Honorable Robert J Lloyd, Chairman,Diane C Pinger,Co Clk.Roll call and the following members present: Supervisors Friedrichsen, Micek, Pfeifer,Franzen,Tooley and Chairman Lloyd .Supervisor Martens was excused for a medical emergency. Motion carried.K.C. Belitz,Chamber of Commerce updated the Co Bd on the Quality of Life Center Study and asked for Platte County’s support. Moved that Platte County participate in the Quality of Life Center Study in the amt of $10000.00 to be paid from the general misc acct.Motion died due to lack of a second. Moved and seconded that Platte County contribute $5000.00 to the Quality of Life Center Study to be paid from the general misc acct.Motion carried.Moved and seconded to remove from the table the proposed Humane Society rate increase. Motion carried. Discussion followed bud a decision was made latter in the meeting. Tom Maul,Atty discussed the engineer and atty contract for E 29th Avenue with the Co Bd.The following resolution was presented: RESOLUTION NO. 09-06 WHEREAS, the County of Platte did, on October 21,2008 by Resolution No. 08-46, authorize the creation of Rural Road Improvement Dist No. 3 of Platte County, for the purpose of paving East 29th Avenue from U.s. Highway 30 North to the Loup Power District Canal; and WHEREAS, PURSUANT to Neb.Rev.Stat. 39-1644 the County desires to employ special engineers and special counsel to assist in this improvement project; and WHEREAS, the Advisory Committee of Rural Road Improvement District No. 3 has recommended to the County Board that Advance Consulting Engineering Services be employed as special engineer and Attorney Thomas M. Maul as special counsel on this project; not therefore, BE IT RESOLVED that Advance consulting Engineering Services is hereby employed as special engineer and Attorney Thomas M Maul is hereby employed as special counsel on this improvement project and that the Bd Chairman is hereby authorized to sign the contracts for services .Adopted this 20th day of January 2009 at Columbus,Nebraska. /s/Diane C Pinger Platte County Clerk Platte County Board of Supervisors /s/Robert J Lloyd Chairman. Moved and seconded to adopt Res No. 09-06 approving the special engineer and special counsel for the E 29th Avenue Paving Project.Motion carried.The One and Six Year Road hearing was held at 10:00a.m. to 11:00 a.m.Moved and seconded to conclude the hearing at 11:11 a.m.Motion carried.Moved and seconded to accept the One and Six Year Road Program as presented.Motion carried.Moved and seconded that the bid opening on the 12th Street Paving Project be on February 9,2009 at 1:00p.m. with the Road/Bridge Comm which they will review and bring back to the Co Bd as a whole on 2-17-2009.Motion carried.Moved and seconded to authorize the Hwy Supt to advertise for steel bids to be opened on 2-17-09 at 9:30a.m. Motion carried.The following resolution was presented: RESOLUTION NO. 09-05 WHEREAS, by Resolution No. 03-14,dated March 18,2003,the Board of Supervisors of Platte County,Nebraska,did adopt certain Rules and Regulations concerning the construction,installation,operation and maintenance of community antenna television (CATV) service pursuant to a required non-exclusive permit granted by this Board of the construction, installation, operation and maintenance of such community antenna television (CATV) system within Platte County,Nebraska, and outside the limits of any incorporated city or village within said County, and WHEREAS, by Resolution No. 03-14, dated March 18,2003,the Board of Supervisors of Platte County,Nebraska did grant a non-exclusive permit (the “Permit”) to USA Companies, LLC d/b/a Cable Nebraska (“USA”) for a period of 5 years until November 15,2008, with a ten year extension provided that USA meets certain criteria, and WHEREAS, USA met the criteria by providing adequate notification as stated in Section 2(a) of Resolution No. 610 for the renewal procedure by providing notification to the County Board of Supervisors on April 4,2006, and WHEREAS, said Resolution stated in Section 5, the Permit shall be extended for an additional 10 years of the Board of Supervisors determines that the holder of the permit in question has satisfactorily provided such community antenna television (CATV) service, and THEREFORE; BE IT HEREBY RESOLVED BY THE BOARD OF SUPERVISORS OF PLATTE COUNTY,NEBRASKA, on this 20th day of January,2009, that USA has proved to perform satisfactory to the requirements stated in the Permit and therefor, hereby grants USA the ten (10) year extension to the Permit until November 15,2018. Public Comments: The reporter from the Col Telegram asked the Road/Bridge Comm why not move things around and put 48th Avenue at the top of the list. The Road/Bridge Comm responded that it’s possible to move things around but stated where is the money coming from. We don’t have the money and personnel to do everything. Committee Reports: Supervisor Friedrichsen did not attend the Juvenile Detention meeting in Madison on 1-16-2009. Supervisor Tooley reported the county’s insurance representative will be here on Thursday the 22nd at 10:00a.m. if anyone has any concerns or issues.
